2. What data we process, and where it comes from
We process personal data from three distinct sources, and they do not all work the same way:
- Data you give us through the contact form: name, work email, company, phone (optional) and whatever you write in the message.
- Data you give us by emailing us directly.
- Professional contact details we obtain from publicly accessible sources for our B2B outreach. Section 4 explains this in detail.
This website uses no cookies, carries no analytics or tracking pixels, and builds no browsing profiles. The cookie policy sets out the detail.
3. Why we process it, and on what legal basis
| Purpose | Legal basis | Retention |
|---|---|---|
| Responding to your enquiry or diagnosis call request | Pre-contractual steps taken at your request (Art. 6(1)(b) GDPR) | 12 months from last contact, unless a contract follows |
| Managing the contract if you become a client | Performance of a contract (Art. 6(1)(b) GDPR) | For the duration of the relationship plus 6 years, for tax and commercial obligations |
| B2B outreach (phone, email and LinkedIn) | Legitimate interests (Art. 6(1)(f) GDPR), with a documented balancing test | Until you object; a record of your objection is kept indefinitely so we never contact you again |
| Meeting legal obligations (tax, accounting, data protection) | Legal obligation (Art. 6(1)(c) GDPR) | The periods set by each applicable law |
We do not use your data for automated decision-making or for profiling that produces legal effects.
4. If we contacted you without you writing to us first
We are a B2B outreach agency: we contact professionals in their working capacity — by phone, email or LinkedIn — to assess whether there is a commercial fit. If you were contacted by us, Article 14 GDPR entitles you to the following information.
- What we process: name, job title, company, work phone number and, where applicable, work email. Never special category data.
- Where it comes from: publicly accessible professional sources such as company websites, business directories, public registers and professional social networks.
- Why we may do this: our legitimate interest in direct B2B marketing, recognised by Recital 47 GDPR. We have carried out and documented the corresponding balancing test, and can provide it on request.
- Which channels: phone, email and LinkedIn, always to professional contact details.
- We call only during business hours and only on professional contact numbers, never personal ones. Emails go to work addresses and always include a simple way to ask us to stop.
- You can object at any time, without giving reasons and at no cost. Just tell whoever contacts you, or write to contacto@bidi.solutions. We will record your objection so we do not contact you again.
You can also register free of charge with the Spanish advertising exclusion list, Lista Robinson (www.listarobinson.es), which we screen against before running our campaigns.
5. Who we share your data with
We do not sell or trade your data. We do work with providers who process it on our behalf, as processors and under an Article 28 GDPR agreement:
| Provider | Purpose | Location |
|---|---|---|
| Vercel Inc. | Website hosting | USA / EU |
| Resend (Plus Five Five, Inc.) | Contact form email delivery | USA |
We may also disclose data to public authorities and courts where we are legally required to do so.
6. International transfers
Some of our providers are located outside the European Economic Area. Where that is the case, the transfer relies on the Standard Contractual Clauses approved by the European Commission or on a valid adequacy decision, together with any supplementary measures required.
You can request a copy of the safeguards in place by writing to contacto@bidi.solutions.
7. How long we keep your data
The specific periods are set out in the table in section 3. As a general rule, we keep data for as long as it is needed for the purpose that justified collecting it and then block it for the limitation periods of any potential legal liability. Once those periods elapse, we delete it securely.
8. Your rights
You can exercise the following rights at any time:
- Access: find out what data of yours we process.
- Rectification: correct data that is inaccurate or incomplete.
- Erasure: ask us to delete data that is no longer necessary.
- Objection: object to processing based on legitimate interests, including marketing outreach.
- Restriction: ask us to suspend processing while a complaint is resolved.
- Portability: receive your data in a structured, commonly used format.
- Withdraw consent at any time where processing is based on it, without affecting the lawfulness of processing before withdrawal.
To exercise them, email contacto@bidi.solutions stating which right you wish to exercise. We will respond within one month at the latest. It is free of charge, except for manifestly unfounded or excessive requests.
If you believe we have not handled your request properly, you can lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos, C/ Jorge Juan 6, 28001 Madrid — www.aepd.es), which is the competent supervisory authority.
9. Security
We apply appropriate technical and organisational measures to protect your data against destruction, loss, alteration and unauthorised access: encryption in transit over HTTPS, role-based access control, minimisation of the data we collect, and selection of providers offering sufficient guarantees.
10. Changes to this policy
We may update this policy when our processing activities or the applicable law change. The version in force is always the one published on this page, with its last-updated date. If a change is substantial and affects you, we will tell you through the contact details we hold.
